Suzanne Kern Booking Terms & Conditions

 

Suzanne Kern (herein referred to as the artiste), The booker (herein referred to as the client)

 

1: The artiste will provide the services of entertainment on the agreed date at the agreed location for the agreed performance times as detailed on the booking confirmation.

2:  The selection of equipment to be used at the event is left to the discretion of the artiste, and is based upon the size and conditions of the event location. The artiste agrees to work self contained.

3: The artiste is not obliged to provide an extended performance which exceeds the times stated on the booking confirmation.

4: The client will provide two 13amp sockets next to the performance area. The client agrees to ensure that there are no sound limiters or other such devices installed. The artiste reserves the right to discontinue all or part of the equipment usage if the power provided is not capable of operating the equipment without risk of damage to the equipment, the artiste, or the public, or if the working environment constitutes a health and safety risk. The surface on which the artiste is to perform cannot be dirt or gravel or any other unstable surface. If applicable, the client agrees to furnish a facility that completely covers the artiste’s equipment from direct sunlight or rain. If the performance must be discontinued for any of the aforementioned reasons, the full balance is still due.

5: The client will be responsible for any damage, normal wear and tear excluded, to equipment (sound/lighting equipment and/or music library) provided during the performance time period as detailed on the booking confirmation, including time allowed for setting up and packing away, unless damage is due to artiste’s negligence.

6: The artiste is to perform in a safe, non abusive environment. Any mistreatment or abuse of the artiste or anyone accompanying the artiste in any way will result in the immediate discontinuing of services with the full balance still due.

7: The artiste is not responsible for power outages, nor is the artiste responsible for any equipment that fails at an event. If the equipment fails the artiste will, on a best effort basis, find suitable back up equipment. The artiste is not responsible for any damage to the room or building where the services are provided.

8:  The artiste will have suitable public liability insurance but is not liable in any way for any injuries that may occur due to the actions of the client and/or the client’s guests and customers. This may include but is not restricted to drunkenness or other forms of intoxication.

9:  The payment for the performance is due at the conclusion of the performance in cash.

10: Where a deposit is required this shall be paid at the time of booking. If the customer cancels the event this deposit shall be non refundable.

11: Notice of cancellation must be in writing and delivered to the artiste before 28 calendar days prior to the event. The Artiste(s) reserve the right to charge a cancellation fee of the full amount within 28 days of the performance date and 50% over 28 days.  As the authorised representative, the Booker is fully aware of the contract entered into and has confirmed that they are booking entertainment on behalf of, and with the express permission to act for the venue/organisation and or party detailed on the booking confirmation. A third party representative can only cancel the Artiste(s) by prior agreement, and the Artiste(s) reserves the right to charge cancellation fee as detailed above. If a Booker/Manager responsible for booking entertainment changes occupation, leaves a respective venue or resigns from a committee, having previously been authorised to book entertainment for that venue or party, this confirmation remains in force as it relates to all and any venue or party representative at the time of making the booking.

12: If the artiste cancels at any time due to proven sickness, accident, equipment malfunction, or acts of God beyond the control of the artiste, the artiste will make a full refund of any monies paid by the client. The client agrees that the refund will be the full extent of damages he or she is entitled to and no further damages may be sought against the artiste.

13: The artiste agrees to be suitably dressed both on and off stage and in  public areas.

14: The artiste agrees to provide publicity material if required.

15: The artiste agrees to provide pre recorded background music between performance times where applicable.

16: The client agrees to ensure that a suitable vehicle parking space is available for the artiste when appearing at the venue.

17: The client agrees to provide additional manpower to help transport artiste equipment both in and out of the venue if there is a staircase of more than 5 steps.

18: The client agrees to ensure that the artiste is provided with suitable changing facilities (changing facility must be located independently and be private from public access). In the event of the client requiring the artiste to arrive early and perform at a later time, i.e. longer than a 2 hour period has passed, dressing room facilities should be of a habitual nature or a suitable waiting area should be provided. The artiste will not change in a toilet area.
